The first letter, first chronologically, was a letter written in October of 1862 by Jasper Barney, a private in an Illinois regiment. He fought for the Union Army, he was a farmer from Illinois and he is writing to his brother-in-law, another family member, about the state of the war and particularly about Emancipation.

The second letter is written the following month, November of 1862, but it is by a white Confederate soldier, prosperous farmer John White to his wife. And he is writing at a moment when militarily, the Confederacy is enjoying more success but Confederate civilians are living with the uncertainties of having a war fought in their own backyard. He's also writing about the Emancipation Proclamation and the fears that it has stirred up amongst Confederate civilians at home. His letter is a very personal letter too, in that he is quite forthcoming with his wife about how much he misses home and how torn he feels between his desire to be home and protect his family and the need to fight this war.

And then the third letter is written in February of 1864. It is by a black member of the 14th Rhode Island Heavy Artillery, a black regiment. And he is writing from the city of New Orleans, which his regiment is occupying at the time to really articulate what he and many other black soldiers see as the stakes, as why this war matters for black Americans in particular.

Men in a regiment, or at least in a company, tended to enlist together. So letters that come from home will be read probably by more than one person, will probably be read out loud. A letter to home will often include a passage that says, "Brother A says to say, 'X, Y, Z'" With Civil War soldier's letters the vagaries of letter survival can skew our picture a little bit. The letters to home have a much greater survival rate than the letters from home to the front.

The letters from home don't survive because soldiers have nothing that they can do with them. Also, before battle soldiers are likely to destroy any personal letters that they have on them. Their fear is if personal letters are found on them that the enemy will somehow use that information.

The Union has the U.S. Postal Service; the Confederacy never really has a very efficient or working postal service. There's travel back and forth between home and the frontlines all the time, so often somebody from home or nearby is in camp and going home and you send letters that way and when that person comes they bring letters. There are also private express companies.

Jasper Barney's in the hospital when he writes the letter. He is trying to recover from a wound so the first part of the letter is about recovering from his wound and that actually in one sense is typical because almost every soldier's letter talks about his health to almost excessive degrees.

The letter is written in October of 1862, and in the fall of 1862 there's quite a lot of turbulence on the Northern home front and regarding the Union Army cause in general. The war militarily had gone fairly well for the Union in the early months of 1862 and then in the summer of 1862 the war started going poorly for the Union militarily and the North sort of woke up to the fact that this was going to be a much longer war than anybody had anticipated. So by the fall of 1862 the Northern home front and soldiers are still trying to cope with that realization.

One of those new measures that is taken to fight the war is the Emancipation Proclamation. The preliminary Emancipation Proclamation had been issued on September 22nd of 1862 and the Emancipation Proclamation really changed the whole aim of a war that had been begun to save the Union. Now it becomes a war also to end slavery. Now those two goals had never been completely separable but the official line had always been "This is a war to save the Union" and not to have really much of anything to do with slavery. Those changes really rocked much of the Civil War North, particularly the Northern home front.

You have quite a lot of dissent among white Northerners over the Emancipation Proclamation. Black Northerners, there is no dissent. They think this is exactly what has been needed since well before the war began. There are a number of issues at stake in the 1862 elections. There are economic issues, there are issues having to do with civil liberties, what actions can and cannot the United States government take during wartime and there's the war and of course there's the Emancipation Proclamation.

Meanwhile you have a number of new soldiers entering the ranks. So you have elections, tumult and dissent, and a host of new soldiers coming into the army, all at about the same time. And that's when this letter is written.

This letter is written by Barney who has actually been in the army for a while. So he is writing as an experienced soldier to his brother-in-law who has just joined. Barney, who would normally show a certain modicum of deference or respect for his more socially-elite and older brother-in-law thinks that this is too important an issue to stand on ceremony and so he tells him straight up, I think that you're wrong, I think that the Emancipation Proclamation is exactly what is needed to end this war. And what is more, you're going to think so too as soon as you have been in the war for any length of time.

Barney is fairly typical, he certainly wouldn't have called himself an abolitionist, he certainly would not have predicted that in less than a year he would be calling for the end of an institution that's older than the nation itself. It's quite a radical thing to talk about ending slavery in the 1860s. He's undergone what is a huge transformation in his thinking. As you can see from the letter to his brother in law, his family has not really kept up with this transition. So a gulf has really opened between many soldiers and their families at home.

He is on the Emancipation question even on the first paragraph, he says, "Now my lady love is more attentive for I got a letter from her yesterday. She is all right on the goose question." "All right on the goose" means how you stand on the slavery question, she agrees with him about Emancipation so he is pleased about that.

Then in the next paragraph he's addressing what he sees as his brother-in-law's mistaken views. "You say in your letter that you or your regiment is not in for freeing the Negroes. I am sorry to hear it. You wanted to know what I and my comrades thought of the Negro question. I think Old Abe's Proclamation is all right and there is very few old soldiers that is against it. It is my opinion that yourself and the greater part of your regiment will be in favor of it before you are in the service six months. I was of the same opinion of yourself when I first came into the service but I have learned better. You said you thought the thing would come to a finish by spring if the Negroes was left alone, but I think you will soon find out different. For it is my opinion that the war will never come to a close while the Negroes is left where they are to raise supplies for the rebel army. Even if we could suppress the rebellion and leave the main root where it was before, it wouldn't be long before they would try the same game as before. But if we take away the main root of evil and confiscate all their property they will have nothing to fight for hereafter."

First of all, it's the war that has changed his opinion. Second of all, it's going to change his brother-in-law's opinion too. His reasoning is actually quite pragmatic, what he's talking about is the recognition that without the institution of slavery there never would have been a war. So if we want the war to end and if we want not to fight it again we have to get rid of the cause. That passage encapsulates quite well a major shift in thinking that goes on. It's a pretty astute analysis on his part and on many soldiers' part that there's no way that the Confederacy could have conducted a four-year war without a slave labor force. The Confederate workforce is mobilized, is in the army.

"Old Abe gave them 90 days and that was long enough for them to come to terms and save their property and Negroes, but it seems like they wanted to go the whole hog or none. Now, I think it is perfectly right to take the hog and leave them none and then if they ain't satisfied, I am in for banishing every rebel and rebel sympathizer from the U.S. I am a whole soul Union man and believe in giving the rebels a lesson to be remembered in after generations. Then we will never be troubled with civil war again."

He's talking about the precise terms of the Emancipation Proclamation here. The Emancipation Proclamation issued on September 22nd is actually more, probably the preliminary Emancipation Proclamation and what it says is that the slaves in the states that are still in rebellion against the Union as of January 1st, 1863, will be freed.

And so essentially it's an ultimatum delivered to states in rebellion and the reverse of it would say, therefore if you return to the Union before January 1st, 1863, your slaves won't be freed. And the Proclamation says that because it is operating in a context of a Constitution that protects slavery.

And so, the Emancipation Proclamation can only justify itself as a war measure. So what he is saying is, Lincoln gave the states 90 days to come back. He gives them a chance to retain slavery and if they won't take that chance, if their demands in terms of greater protection for slavery are more important to them than coming back in the Union and keeping slavery where it is then they made their own bed and let them lie in it.

By the time Barney writes this letter he has no qualms at all about confiscating the property of even non-combatants. As he sees it now the only thing that's going to end this war is to take a much harder line, to take away the root of the war.

And in the next paragraph he wants to assure his brother-in-law that 'I am not some wild-eyed abolitionist here, I am not a crazy reformer, this is in fact what most of us hardened commonsensical soldiers think.' He says, "Well, I think I gave you a very good sample of the opinions of myself and comrades."

I think the next paragraph is a good clue into the sort of limits of growing Emancipation sentiment among the Union Army, in other words he is all for ending slavery, but ending slavery is quite different in his view from increasing rights of former slaves or anything approaching racial equality.

You see that when he says, "P.S. I am not in favor of freeing the Negroes and leaving them to run free and mingle among us. Neither is such the intention of Old Abe, but we will send them off and colonize them. The government is already making preparations for the same and you may be assured it will be carried into effect."

So he doesn't know what should become of former slaves, but he certainly doesn't want them living among his own friends and family in the North. He refers to a passage in the preliminary Emancipation Proclamation that does not mandate but suggests as a possible outcome for former slaves, 'maybe they'd be happier if we send them back to Africa or to some place in South America and they could start their own society.'

By the time of the final Proclamation all reference to colonization has been omitted. Slavery was Southern, but prejudice was nationwide. And so colonization was sort of a way of coping with the tension between the insistence that we really need to get rid of slavery and uncertainty about what do we do with real slaves?

The Confederate soldier is named John White. He is part of the army of Northern Virginia, which is the fabled army of Robert E. Lee and he is writing from Fredericksburg, VA, in late November of 1862. So he's essentially writing while Union forces are getting ready to try and take Fredericksburg. It's cold, it's miserable, it's wet, his letter may or may not make it outside of battle lines. He's writing to his wife, there are armies in her backyard. Moreover, White's wife lives in a part of the state where there are slaves and there is a terror that the war is going to inspire a slave insurrection. Those fears are present from the very beginning of the war but at the time of the Emancipation Proclamation they become even more acute.

There is more uncertainty and there is a lot more worry in his letter. Even though militarily the war's going a lot better for his side at this time than it is for Barney's side. The Confederacy is very centralized, much more centralized than the Union and the Confederate Government nationalizes the economy to a much greater degree than the Union could even dream of doing.

And there's major disagreement about whether the Confederate State has any authority to do this. The reason why that disagreement doesn't spill over into a massive rush to rejoin the Union is all that stuff stinks, but it's not as bad as the Union. And I think that's the calculus that goes on in the minds of most Confederate soldiers. It's not liking the Union more than liking or feeling any attachment to the Confederacy that keeps the Confederate army in the ranks. Civilians are ready to throw in the towel a lot earlier than soldiers are.

He starts off by talking about a local neighbor's and he explains that's how he got some letters from his wife and is able to send some letters to her. But then, he hasn't even gone through the state of his health or the health of all their children or their friends at home before he gets to his concerns about the possibility of slave insurrection.

So his two main concerns, right from the outset are one, we can't be in touch with each other as much as I would like us to be and two, you're worried and I'm worried about slave uprising.

He talks about the battle that he calls Sharpsburg and Union soldiers would call Antietam. The battle of Antietam took place on September 17th of 1862, right before the issuance of the Emancipation Proclamation. The Confederacy stages a number of invasions of Union soil in the fall of 1862. Robert E. Lee's army marches into Maryland and the Union Army meets the Confederate Army at Sharpsburg, the name of the town in Maryland, along a creek called Antietam Creek.

The Confederates tend to name battles after the town nearest where a battle is fought while the Union tends to name battles after natural features, most often bodies of water. Militarily that battle was a draw, but it counts as enough of a Union victory because the Confederates were trying to invade the North. Their invasion was stopped at Antietam. And so the Confederates retreat back into the Confederacy.

Confederates do not see this as a devastating defeat by any means, but the Union has been so desperate for a victory because Lincoln has been trying to find a way to issue the Emancipation Proclamation since the summer of 1862. But he did not want to do it at a time when the Union Army appeared to be failing because then it would just look like a desperate move and that's not how he wanted it to look.

As you can see from White's description of the battle, he saw it as a terrible battle. But he doesn't really see it as a major Confederate defeat.

"Oh Matt, it almost makes me shudder to think of it. How will the 17th of September live in the memory of the 32nd Virginia Regiment and its friends? Oh, it was an awful day. Imagine my feelings, if you can, when I saw my comrades and friends falling all around me from the death-dealing shot and shell of the enemy and knew not how soon it would be my fate. Thanks be to a kind providence, I came out unhurt but narrowly escaped. A ball passed through my blanket between my body and right arm. I shot my gun until I could hardly get a cartridge down her. Finally, they gave way and ran, hotly pursued by our brigade, the 32nd leading the charge until pursuit was dangerous. They were said to be three to our one."

He's writing this more than a month later, but it's still a pretty fresh impression of his experience of battle. It's such an overwhelming experience to be in a Civil War battle. The impressions are roaring noise, and smoke, and a horrific smell. And those are hard sensations to really write precise words about. And so there are a series of stock phrases that soldiers tend to fall back on. There's nothing in her experience that he could compare it to. It doesn't so much make his description hollow as highlight the enormity of the experience, because he's clearly an eloquent man, and yet that's too overpowering for him.

But it's really important to him for two reasons, one, the enormity of the battle itself but two, it becomes the occasion for this Emancipation Proclamation. White and his wife aren't shocked by the Emancipation Proclamation so much, they sort of have expected it, they thought since the beginning that the Union was out to destroy slavery and all this talk of Union is really just a red herring. But the Emancipation Proclamation makes those fears more real for them. Moreover, they worry that slaves are going to hear about this Emancipation Proclamation and will become emboldened and as a result will start holding uprisings and possibly go on killing sprees.

"Dear Matt, I must tell you I am in a hard place and know not what to do. When I think of my sufferings, both in mind and body which are indescribable and how much my services are needed home, I am tempted to try and get there. I see no probability of getting there if I remain in the service. The war is likely to last for years yet and I cannot reasonably expect to survive it. Besides this, you are threatened with an insurrection," which is again a reference to the slave uprising that they fear is going to happen because of the Emancipation Proclamation, "and how better can I die than defending my family and fireside. To do this, I came in the war and now that you are threated, I consider it my Christian duty to come to your rescue and protection. Dear Matt, you know that I love my country but I love my family better."

And I think in that passage he captures the dilemma that's going to be a dilemma for a great number of Confederate soldiers. And the dilemma is this; most Confederate soldiers don't own slaves. Two thirds of white families in the Confederacy are not slave owners. But they're not stupid, they know full well that this war was begun to protect the institution of slavery and they're not embarrassed about that. In fact, they agree that it was important and the reason why is not necessarily that they own slaves, they live in a place where 40 percent of the population is black. Parts of the Confederacy, the majority is black slaves. And they honestly believe that the two races cannot live together harmoniously without the institution of slavery.

"Dear Matt, you know that I love my country but I love my family better." Now that sounds to me like a very unguarded moment. That's not the sort of sentence you would want anyone you didn't really trust to see. Particularly in wartime when there were questions of loyalty, when there were questions of patriotism, when your own honor rests in part on your reputation for fearlessly defending your country. There's no censorship, there's no official mechanism by which superior officers are going to read his mail. But you don't know that it's not going to go amiss, that it's not going to get dropped somewhere and have someone pick it up. So that he took that risk really underscores the sincerity of that line for me.

The problem is, that if the heart of the motivation is to protect what one sees as the best interests, the health and the safety of one's family. And then the war to protect one's family starts threatening one's family, what do you do? Does he best protect his family by staying in the army and trying to secure an independent Confederacy where slavery will be protected forever or does he best help his family and protect his family by going home so that if there is an insurrection he's there to take care of them? And that tension will haunt him and will haunt most Confederate soldiers really for the rest of the war and is at the heart of the war experience for a very great many Confederate soldiers.

The third letter is written by a black Union soldier to the editor of the most prominent African American newspaper during the Civil War, the Weekly Anglo-African and black soldiers throughout their term of the service in the Union Armies do this. They write to Northern newspapers, particularly black newspapers, about their soldiering experience. The majority of black Union soldiers were former slaves who could not read and write and so we don't have letters from them. Who we have letters from are the minority, who are Northern free blacks, who could read and write before the war. They sort of see themselves as having obligations, not just to their family, representing the war experience to their family, but to a broader, at least black, public.

He is writing from New Orleans, LA, in February of 1864. This soldier is a member of the 14th Rhode Island Heavy Artillery. New Orleans has been under Union control since May of 1862 so he is really an occupation force.

He is also fighting two battles at once because initially black Northerners who tried to join the Union Army were refused. Black soldiers were not accepted into the Union ranks until 1862 and they didn't join in big numbers until 1863.

Once they're in the ranks, they're paid less. At first there are no black officers and at first they are barred from combat duty. So he is fighting to save the Union and to redefine it, to redefine it as a place where he and people like him are seen as citizens, are seen as invested with the same rights and promises as white Americans are. And you see evidence, I think, of both battles in this letter. The immediate audience for the Anglo-African is Northern blacks. However, all newspapers in the 19th century have a habit of picking up letters, columns, articles from one paper and running it in their own pages. There is always the chance that this could run in a white newspaper too.

So he always has a definite audience and a potential audience in mind.

"I will give a brief account of the battalion to which I am now attached, and to which I hope to belong until this cruel war is ended, and the nation enjoys once more the blessings of peace." Well there he's talking about Union versus the Confederacy but then the next passage after that he's onto the battle for respect for citizenship, for equality within the Union itself.

"The Battalion is composed of as good material and contains as brave hearts as any equal number of men that ever shouldered a musket in this war." We are just as good, we are just as brave as any other soldiers, including the white ones, is what he's saying there. "These men have left their own dear homes, their wives and children, of their own free will: why, then, should they not fight?" We have made the decision to fight in this war, just as white men have, so if one of the sort of hallmarks of fitness for citizenship is the ability to reason, to excerpt one's own free will, look, we have done that.

"Yes they will," fight, "as they know full well that this is the golden opportunity that they have given them to establish their manhood, and capability as soldiers before the world."

Manhood shows up all the time in black soldier's letters and it can have one of two meanings. Sometimes it means recognition of the full humanity of all black Americans. In this one, though, he clearly means the adult male identity of black men because one characteristic of the adult man in 19th-century American culture is the ability to take care of a family, the ability to support a wife and children. And its men who are entitled to full political rights and he has twice told his readers that 'we have characteristics of manhood. One is in the moral agency, that we of our own free will decided to do something and two is, we have wives and children, we support families. We therefore have the attributes of adult males and are entitled to the rights of adult males.' So he means manhood in that explicitly gendered way.

The next and final paragraph is a very conventional one. This is the sort of thing that shows up in a number of public letters. "If it be my lot to fall on the battle-field, I shall be content to die far from home and friends, if my ears are saluted by the shout of my comrades, 'The battle is over; the stars and stripes wave triumphantly, and the slave is free!' This is a letter that is not just telling loved ones how he feels but is really also fighting this very public campaign for respect for black soldiers and for African Americans in general.

He signs it with the name Macy and this is another challenge of working with black soldiers' letters. They take pseudonyms all the time. I don't know who this soldier is. That could have been a nickname, it could have been his first name, and he in fact does give his company and his regiment. But he doesn't sign his full name and so positive identification is a lot harder with black soldiers than with white soldiers.

I think juxtaposition works pretty well with letters. The Union and Confederate and the white and the black letters really do sound different. Students I think generally like reading letters too. They feel like real people that seems interesting to them. But having them read the letters against each other, just asking them what jumps out to you, what are they talking about, what strikes you, what surprises you, initial reactions.

With these particular letters it'll work pretty well. If what you want them to talk about is the Emancipation Proclamation it's all over those first two letters. Another strategy, a sort of teaching assignment might be to imagine the letter in response. You could talk about home front and battlefield using these letters because you could ask students to imagine how might Jasper Barney's brother-in-law have responded to this letter. Asking them to imagine responses I think also really makes them really engaged with the questions and the issues that are raised by the letters.

There's not a lot of talk about politics in the Union letter and there's often politics in Union letters. There's not overt criticism of Jefferson Davis or some aspect of the Confederacy in the Confederate letter which there often is in Confederate letters. At the time black soldiers are fighting for equal pay and you'd expect that to show up and it doesn't. In February of 1864 that's a hot issue and it not showing up is a little surprising. That is the drawback to using one letter. Of the letters that went amiss from John White, 12 of them might have talked about something that you would expect, but this letter doesn't. So, it's hard sometimes to resist the temptation to think we know everything about him from this one letter. We don't.

To what extent did African Americans, slave or free, fight for the Confederacy?

Answer

While there are isolated instances of African Americans serving in the Confederate ranks, there is overwhelming evidence that this small number represents rare and exceptional cases: historian David Blight estimates that the number of black soldiers in the Confederate ranks was fewer than 200. That small number represents some partial companies of slaves training as soldiers discovered by Union forces after the fall of Richmond. One reason that only a handful of blacks fought for the Confederacy is that until the last weeks of the war, the Confederate Congress expressly forbade arming enslaved African Americans, who made up the vast majority of the black population in the South. Given white southerners' longstanding fears of a slave uprising (fears intensified by a few abortive attempts in the first half of the 19th century and exacerbated to the point of hysteria by John Brown's raid on Harper's Ferry in 1859), the acute resistance of Confederates to arming blacks is understandable. Putting muskets in the hands of enslaved African Americans presented more than simply a concrete threat—embracing the notion that blacks could serve as soldiers in the same fashion as whites threatened deeply-held Southern ideas of race-based honor and masculinity. As Confederate Secretary of State Robert Toombs put it, "The day the army of Virginia allows a negro regiment to enter their lines as soldiers, they will be degraded, ruined, and disgraced."

Opposition to African American soldiers was passionate on both sides. The notion of fighting alongside blacks violated many deeply-held beliefs of white Northerners and Southerners alike.

Northerners were scarcely more enthusiastic about arming African Americans than their Southern counterparts. For the first year and a half of the war, Abraham Lincoln's administration eschewed the enlistment of black troops, fearful of a public backlash. Not until Lincoln signed the Emancipation Proclamation on January 1, 1863, did the Union Army begin to enroll African Americans in its ranks; even then, the decision proved deeply controversial, particularly among Northern Democrats. The Confederacy did not seriously entertain the idea of arming enslaved African Americans until a full year later, when the war situation in the South had grown much more desperate. In January 1864, months after the defeats at Gettysburg and Vicksburg, Patrick Cleburne (one of the most successful combat commanders in the Confederate Army) circulated a proposal to arm the slaves. Northern successes on the battlefield, Cleburne argued, threatened the South with "the loss of all we now hold most sacred—slaves and all other personal property, lands, homesteads, liberty, justice, safety, pride, manhood." Sacrificing the first, Cleburne held, could save the rest; the Confederacy could check Union advances by recruiting an army of slaves and guaranteeing freedom "within a reasonable time to every slave in the South who shall remain true to the Confederacy." A dozen of Cleburne's subordinates backed his proposal.

Lee wrote a letter to a Confederate congressman characterizing the plan as "not only expedient but necessary."

To most Southerners, however, Cleburne's plan was appalling. The prospect of arming the slaves struck one division commander as "revolting to Southern sentiment, Southern pride, and Southern honor." A brigade commander suggested that accepting enslaved African Americans as soldiers would "contravene the principles upon which we fight." Sensing the potential for the debate to cause dangerous dissension within the ranks, Confederate President Jefferson Davis ordered the generals to cease the discussion. Debate over the decision to arm enslaved African Americans resurfaced many months later, as the Confederacy's situation grew progressively more dire both on and off the battlefield. When another similar proposal reemerged it carried the imprimatur of Robert E. Lee, commander of the Army of Northern Virginia and perhaps the most revered figure in the South. In February 1865, Lee wrote a letter to a Confederate congressman characterizing the plan as "not only expedient but necessary." Even with Lee's support, though, the bill proved deeply divisive. It was not until March 13, 1865, just weeks before Lee's surrender, that the Confederate Congress passed legislation allowing for the enlistment of black soldiers. The two companies discovered by Union troops after the fall of Richmond never went into battle. Opposition to African American soldiers was passionate on both sides. The notion of fighting alongside blacks violated many deeply-held beliefs of white Northerners and Southerners alike. In the Union army, African Americans served in segregated regiments under white officers; many were used for menial tasks rather than fighting, and those that went into combat suffered abuse from their white comrades and were often singled out as targets by their Confederate foes. Nevertheless, the vast majority of African American troops fought bravely and with distinction, and by the end of the war, their actions in combat had begun to change the assumptions of at least some of their comrades regarding the fitness of blacks for battle. Despite their demonstrated fighting ability, it was nearly another full century before the United States Army finally desegregated individual units.

How can a person born in the U.S. to one U.S. citizen parent and one non-U.S. citizen parent (divided allegiance) be defined as a 'natural born citizen?'

Shouldn't a 'natural born citizen' be defined as being born with allegiance to the U.S. only?

Answer

Throughout the history of the United States, there has been a consistent evolution of who a citizen is and how a citizen is defined, as the United States Constitution has been both decided upon and modified on various occasions to expand the definition of who is a citizen and guarantee equal rights for all individuals. In the late 18th century, a citizen was defined as a white, male landowner, and African Americans could legally be held as slaves. The 1857 Dred Scott v Sandford Supreme Court case affirmed this definition. The Oyez Project (2005–2011) puts forth that in this case the Court found that "no person descended from an American slave had ever been a citizen." Six years subsequent to this decision, President Lincoln issued the Emancipation Proclamation, which declared "that all persons held as slaves within the rebellious states are, and henceforward shall be free."

The 14th Amendment guarantees that a person born in the United States is thereby a citizen, even if both parents are illegal immigrants.

This change was reflected in the Constitution of the United States in the 14th Amendment (1868), which states "All persons born or naturalized in the United States . . . are citizens of the United States and of the State wherein they reside," as well as the 15th Amendment (1870), which puts forth that "The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of race, color, or previous condition of servitude." However, the next half century still saw roughly half of the country's population without full citizenship rights, as it was not until 1920 that the 19th Amendment was passed that granted women suffrage. To answer the particular question posed above, simply put, the 14th Amendment guarantees that a person born in the United States is thereby a citizen, even if both parents are illegal immigrants. However, this is not without controversy, and it has become a political issue, as citizens born to illegal immigrants have derisively been referred to as "anchor babies." For more on this issue, try searching the New York Times using the phrase "anchor babies." However, American children of foreign parents can be dual citizens depending in part on the rules of the other country. This status is conferred when "an individual is a citizen of two countries at the same time." The website newcitizen.us describes potential benefits to being a dual citizen; among them are "the privilege of voting in both countries, owning property in both countries, and having government health care in both countries." However, the U.S. Department of State puts forth that the U.S. government "does not encourage" dual citizenship "because of the problems it may cause," particularly that "claims of other countries on dual national U.S. citizens may conflict with U.S. law, and dual nationality may limit U.S. Government efforts to assist citizens abroad." To answer the initial question in regards to allegiance, allegiance may be more the way a person feels rather than actual law. On this topic the U.S. Department of State notes that "where a dual national is located [where the citizen resides] generally has a stronger claim to that person's allegiance."

Sarah Jencks: First take: What are some of the things you notice, both about the content, what he’s saying, and also about the way he goes about saying it? Just a quick phrase or what words or phrases stick out to you here?

Teacher: Well, there’s some old Biblical references.

Sarah Jencks: Yeah, he calls on the Bible a lot, absolutely

Teacher: That’s strange for us in the 21st century

Sarah Jencks: And he also, it’s clear he assumes people know that those quotes are from the Bible, right, because he doesn’t say these are Bible quotes, he just does it. What else?

Teacher: He brings sort of a why he said some things in the first inaugural address and how this is going to be different, lays out and prepares for what he’s going to say.

Sarah Jencks: He definitely starts off by saying this is a new day, this is a different time. Absolutely. What else? What other things do you notice in here? Yeah.

Teacher: Malice towards none is sort of the start of the Reconstruction.

Sarah Jencks: So yeah. So at the very end of the speech, he’s definitely moving forward and he’s setting a tone for what his expectations are. Absolutely. What else?

Teacher: I think he reaffirms the notion that we’ve seen since the Emancipation Proclamation, that originally the war was about preserving the Union, but now he’s very clear that it was about ending slavery.

Sarah Jencks: Absolutely. Yeah, he really states it. He even goes further than that. We’ll talk a little bit more about that. What else? What else do you notice? Anything about the structure?

Teacher: I’m just struck by the rather severe comment that God wills the retribution.

Sarah Jencks: Yeah, there’s nothing light or casual about this middle paragraph. Anything else? Okay, let’s try to take a second pass at this, and as we’re doing it, I want you to think about those things, about the references, the Biblical references, and let’s also—we’ll pay attention to these different paragraphs. He starts by saying it’s a new day, then he goes into talking about what it was like in the country at the beginning of the Civil War in the next paragraph, and then he goes into this really intense paragraph about slavery and about why this war—he’s got an idea why this war happened. And then moving us towards post-war times. And just quickly I want to remind you, do you all know what the day was that Abraham Lincoln was assassinated? Do you remember?

[Murmuring answers]

Sarah Jencks: April 14th. He was assassinated on the 14th, he died on the 15th. And what is this date right here? March 4th. So it’s how much earlier? Yeah, just like a month and a half. It’s not much. He hardly had a second term.

Teachers reading: Fellow-Countrymen: At this second appearing to take the oath of the Presidential office there is less occasion for an extended address than there was at the first. Then a statement somewhat in detail of a course to be pursued seemed fitting and proper. Now, at the expiration of four years, during which public declarations have been constantly called forth on every point and phase of the great contest which still absorbs the attention and engrosses the energies of the nation, little that is new could be presented. The progress of our arms, upon which all else chiefly depends, is as well known to the public as to myself, and it is, I trust, reasonably satisfactory and encouraging to all. With high hope for the future, no prediction in regard to it is ventured.

Sarah Jencks: Okay, let’s stop for a second and talk about some of the things he’s doing in this first paragraph. It’s funny, I’ve been doing this for three years, and I just noticed a new thing, so what, what are some of the—he’s very skilled in the way he’s structuring this. What are some of the things that he’s doing in this first paragraph. How is he—what is he trying to do as he introduces this speech? What do you see?

Teacher: Well, ’high hope for the future, no prediction in regard to it is ventured.’ Like, he has a plan, he’s not quite sure how it’s going to go and how it’s going to be accepted.

Sarah Jencks: Yeah, and, you know, that’s the part that I just noticed something for the first time. He doesn’t ever say in this speech, and the Union is going to win, which was clear by then. It was clear by March 4th that the Union was going to win. Why wouldn’t he say that? Why might he choose not to say that in this speech? Given what else he knows?

Teacher: He feels he’s a president of all the states.

Sarah Jencks: He doesn’t want to stick it to the South. He’s specifically saying no prediction is ventured, I’m not going to go there. It’s an interesting way for him to start this.

Teacher: So he’s already thinking about healing.

Sarah Jencks: Exactly, exactly. Yeah, yeah, we’re not going to start this speech by saying we’re winning, we’re doing it.

Teacher: Well, he even has sense before, ’reasonably satisfactory,’ he doesn’t go jump and say that we’ve won, pretty much, it’s very—

Sarah Jencks: I just heard, I’m sorry, I don’t know—yes. Yeah. And very measured. He’s very careful how he does that.

Teachers reading: On the occasion corresponding to this four years ago all thoughts were anxiously directed to an impending civil war. All dreaded it, all sought to avert it. While the inaugural address was being delivered from this place, devoted altogether to saving the Union without war, insurgent agents were in the city seeking to destroy it without war—seeking to dissolve the Union and divide effects by negotiation. Both parties deprecated war, but one of them would make war rather than let the nation survive, and the other would accept war rather than let it perish, and the war came.

Sarah Jencks: Okay, let’s stop again. Um, he’s still talking about the previous inauguration and the beginning of the war here, and he does a lot of this ’then and now.’ If you notice, in the first paragraph, he says ’then the statement seemed fitting and proper, now, we don’t need it anymore.’ So, what do you notice about this paragraph, what are some of the things you notice about what he’s saying at this paragraph? I’m going to say one—are there any hands back there that I’m missing? Yes.

Teacher: I was just going to say he’s very balanced. He’s not placing blame. And, you know, in these last few sentences, he states what one party did, then what the other party did, and then response one party did, and the other party did. He’s very—it gives a very balanced perspective.

Sarah Jencks: And what’s the—this is just a little grammar thing that I sometimes do with kids when I’m looking at this. In that very last clause of the paragraph, who’s taking the action?

Teacher: The war itself.

Sarah Jencks: Yeah. Isn’t that interesting? It’s not a person on either side. It’s the war is the subject.

Teacher: And he also does a similar thing by saying that insurgent agents, he’s not saying the whole South, the government, you know, or the leaders of the South, like agents, like I know it’s not everyone, it’s just these few.

Sarah Jencks: And he also says in that second sentence, notice the way he says all dreaded it, all sought to avert it. Nobody wanted war.

Teacher: I think he does nail, though, who he feels started it.

Sarah Jencks: Yeah, yeah. It’s true.

Teacher: Makes it clear.

Sarah Jencks: It’s true. He says one of them would make war rather than let the nation survive. And the other would accept it. No, you’re absolutely right, you’re absolutely right. I mean, he’s not saying nobody’s responsible here, but he is really being careful about the way he phrases it. Um. We’re ready to keep going.

Teacher: Okay.

Sarah Jencks: Okay.

Teachers reading: One-eighth of the whole population were colored slaves, not distributed generally over the Union, but localized in the southern part of it. These slaves constituted a peculiar and powerful interest. All knew that this interest was somehow the cause of the war. To strengthen, perpetuate, and extend this interest was the object for which the insurgents would rend the Union even by war, while the Government claimed no right to do more than to restrict the territorial enlargement of it.

Sarah Jencks: Okay, I’m going to stop us here, because this is a really long paragraph. What’s he doing here? He’s moving on from talking about what happened at the beginning and who was responsible. He’s going a little deeper here. What’s he doing?

Teacher: He’s kind of always said that the cause of the war was to save the Union, but here he’s saying that even though we always said it was to save the Union, we knew that this was slavery and this institute had something to do with it.

Sarah Jencks: And who knew? According to him?

Teacher: Everybody.

Sarah Jencks: Everybody. He does it again. All dreaded it, all sought to avert it. All knew that this interest was somehow the cause of war. He’s not letting anyone off the hook here. What else? Do you recognize any language here, from other studies of slavery or anything?

Teacher: A peculiar institution.

Sarah Jencks: Exactly. A peculiar and powerful interest. Absolutely. And I think it’s really interesting the way he says to strengthen, perpetuate, and extend this interest was the object to which the insurgents would rend the Union even by war. I love that image, his use of that word, to rend the Union, because I always think of sort of tearing fabric or something.

Teacher: He’s also in the next part of that sentence talking about, you know, I didn’t say that I was going to abolish slavery at the beginning, I was not—I was going to let the states deal with it, the territory. He says, hey, you know.

Sarah Jencks: Other "than to restrict the territorial enlargement." Part of what I like about this speech also is that it sort of like gives you like, the whole history of, you know, the early part of the 19th century. He addresses so many issues that you can then make connections to. Okay, let’s keep going.

Teachers reading: Neither party expected for the war the magnitude or the duration which it has already attained. Neither anticipated that the cause of the conflict might cease with or even before the conflict itself should cease.

Sarah Jencks: Okay, stop for just a second. What is he saying here? He’s addressing something that happened in January 1865 here. The cause of the conflict should cease before the conflict itself should cease. Does anybody know? Do you remember from down—

Teachers: The Emancipation Proclamation.

Sarah Jencks: The Emancipation Proclamation, yes, that was in 1863. January 1865, the Congress passed the 13th Amendment. And so it hadn’t been ratified yet, it wasn’t ratified until December 1865, but it had been passed by Congress. And so he lived to see that happen, and that was yet another sign that it was—we were in the endgame.

Teachers reading: Each looked for an easier triumph, and a result less fundamental and astounding.

Sarah Jencks: I love that sentence because the kids often, they think, they’re not used to these words being used in such a powerful way. A result less fundamental and astounding. Just changing the whole country. Keep going.

Teachers reading: It may seem strange that any men should dare to ask a just God’s assistance in wringing their bread from the sweat of other men’s faces, but let us judge not, that we be not judged. The prayers of both could not be answered. That of neither has been answered fully. The Almighty has His own purposes.

Sarah Jencks: Okay, let’s stop again. So he’s making a transition here from determining what the cause of the war was to what? What’s going on here?

Teacher: It’s in God’s hands.

Sarah Jencks: It’s in God’s hands. Where do you see that?

Teacher: It’s just the [unintelligible] that I’m getting from the actual—the whole Bible and everything else, it’s just kinda like this is fate now.

Sarah Jencks: He’s doing something more here with that. The way he was using 'all' before, he’s using—do you see he’s using that here as well? What words does he use here to bring people together?

Teacher: Neither.

Sarah Jencks: Neither and also—does anybody see anything else? Both. Yep, neither and both. He’s bringing everybody—he’s saying, we may not be seeing this from the same perspective, but we’re all seeing it together.

Teacher: And I take that both sides here have lost. Neither side is jumping for joy.

Sarah Jencks: Yeah. Yeah, absolutely. Absolutely. And he really is bringing everybody together. Let’s talk about that dig for a second. What’s his dig here?

Teacher: That the prayers of both could not be answered.

Sarah Jencks: The prayers of both could not be answered. That of neither has been answered fully. They could—we can’t—we’re not—we’re not going to be satisfied. What’s he—his previous sentence, though, may seem strange.

Teacher: Yeah.

Sarah Jencks: What’s going on in that sentence? Anybody want to read it aloud again? Somebody just go ahead. Go ahead.

Teacher: Uh, okay. ’It may seem strange that any men should dare to ask a just God’s assistance in wringing their bread from the sweat of other men’s faces, but let us judge not, that we be not judged.’

Teacher: Is that a dig against slavery, then?

Teacher: Yeah.

Sarah Jencks: What’s he—how do you take that?

Teacher: You’re making money from someone else’s work.

Sarah Jencks: Yeah. But who do you think he’s talking to there?

Teacher: I think to the South.

Sarah Jencks: You think he’s talking—okay, tell me more about that.

Teacher: Slaveowners.

Sarah Jencks: Slaveowners. Okay. And the workforce. Think about the Northerner here, for a second. Why might that sentence—and I’m just thinking of this right now, so don’t think I’m so far ahead of you here. Why might that sentence be addressed to a Northern audience?

Teacher: He’s critical in that the Northerners really didn’t maybe speak up more loudly against it, that they even have labor issues themselves.

Sarah Jencks: Remember he quotes the Bible here, though. He says it may seem strange that slavery exists, but, let us judge not, that we be not judged. So yeah, he’s bringing up issues of labor in the North, and he’s saying hey, you Northerners, you abolitionists, you may think those Southerners are pieces of white trash, but let us judge not so that we be not judged. You’re not God. It’s interesting because he’s got many many audiences here, and we’re going to be playing with that in the minute.

Teacher: I was thinking similar to the reference that he used, let he who casts the first stone be without sin, so, you know, it seems like another Biblical reference or reference to that part of the Bible.

Sarah Jencks: Yeah, absolutely. Let’s keep going. Let’s go.

Teacher: Woe—

Sarah Jencks: My apologies for cutting you off.

Teacher: It’s okay. ’Woe unto the world because of offenses; for it must needs be that offenses come, but woe to that man by whom the offense cometh.’

Sarah Jencks: What does this mean? What does this Biblical quote mean? Let’s break it down, because it’s not an easy one. ’Woe unto the world because of offenses; for it must needs be that offenses come, but woe to that man by whom the offense cometh.’

Teacher: I mean, to go back to the Biblical language, he’s saying something along the line of it’s a shame that we have to live in a world of sin, this is a sinful world, so we should feel sorry for ourselves, and this is a place where sin is going to happen, but God help the sucker who commits the sin.

Teacher: Yeah.

Teacher: Bad things happen, but this could have been avoided.

Sarah Jencks: Right, and also you’d better not be the one who’s actually doing it. Yeah, absolutely, and what he’s doing, it almost looks here like he’s setting up the South, but then let’s see what comes next.

Teacher: You wonder if there’s a little confusion in the speech. He starts out saying it’s about saving the Union, then he ends up saying, well, this is really about retribution for slavery. Which is it?

Sarah Jencks: It’s the big question of the Civil War, isn’t it?

Teacher: It strikes me, realistically, you can’t have it both ways, even though he wants it that way.

Teacher: Couldn’t you read it, though, as more of a superficial understanding—

Teacher: Superficial is my middle name.

Teacher: No, no, I mean, the whole thing about preserving the Union, that sort of, you know, the reading of it, initially, but then, you know, we spent the whole week studying Lincoln and how he agonized over this stuff in his summer retreat and then at a deeper level, he’s looking for a more meaningful way to frame the whole thing, so that it’s not necessarily contradictory, but just deeper readings of the same situation.

Sarah Jencks: I would throw out to you also that Abraham Lincoln was the consummate politician. He was a great leader. That’s separate from his having been a great politician. And that he was very conscious of the laws of the land and the way that he handled this war in the first half of the war. And in the second half, he started to become much—he was looking for a deeper meaning. For himself, with the death of his son and the death of all of these soldiers, whom he was mourning. And he really started drawing on—looking for a deeper meaning in a different way. So that doesn’t answer your question.

Teacher: Back in the 19th century, didn’t most Americans, or at least, you know, the elites believe that democracy was a divine act? I mean, Reagan wasn’t the first person to say that United States was a city on the hill. You know, you’ve got Melville[?] and all these other guys referring to it that way, so for Abraham Lincoln, couldn’t that also be the case. That to preserve the Union was to keep God’s purposes, God’s will going on Earth, because as long as democracy was there, justice could be done.

Sarah Jencks: That’s really interesting. Yeah, and that was, it was Winthrop, it was that early on, the city on the hill concept started.

Teacher: Remember that, yesterday, talking about how the Declaration of Independence was the apple, yeah, the Constitution is the rain. Goes right back to that.

Teachers reading: With malice toward none, with charity for all, with firmness in the right as God gives us to see the right, let us strive on to finish the work we are in, to bind up the nation’s wounds, to care for him who shall have borne the battle and for his widow and his orphan, to do all which may achieve and cherish a just and lasting peace among ourselves and with all nations.

Teacher: I mean, this is what brings the whole thing full circle. From the introduction, what Mike said about it started out trying to preserve the Union. Yes, slavery was a major part of it, but, I think, you know, events change people. You’ll have a belief when you’re a younger person and then as you get older and as experiences start to mold and shape you, you start to—especially having a child or something else—it makes you think differently. And this war, with the loss of his own child and the loss of all these mother’s children, changed him. So he needed to get back to a place that brings us back together.

Sarah Jencks: I see also that he’s using this whole Biblical kind of exegesis almost to set up what he says in the last paragraph. Because if none of us are responsible, then we have to move forward, we have to strive on with malice towards none and charity for all. We can’t hold it against anyone.

Teacher: Especially when he said back a few sentences before that both sides have committed sins during the course of this war. Teacher: Yet does he really say that nobody’s responsible, or does he say that we’re all responsible. I sort of get the sense he’s saying that we’re all responsible.

Sarah Jencks: Yes, I agree with you. I totally agree with you. We are all responsible.

Teacher: But he still names the insurgents.

Sarah Jencks: Yes.

Teacher: We’re still pointing the finger somewhere.

Teacher: I still wonder, to what degree does Lincoln himself take personal responsibility for all this tremendous loss. I mean, in the first inaugural, I lot of you are remembering, he said, I’ve taken an oath to preserve the Union. So I’m this passive agent, essentially, and I must follow my oath. But of course he didn’t have to follow his oath exactly as he saw it. He had other choices.

Teacher: And I think—

Teacher: What do you think?

Teacher: He wasn’t passive. You know, he used the Constitution to his benefit and that other times he expanded powers in it and stretched things and kind of toyed with it in order to achieve a goal. And you’re saying he’s a master politician, he wasn’t just—he wasn’t, in my opinion, this ’I’m a moral person that’s just following my oath,’ he was very deliberate in what he did, he was very calculated in what he did, and the way things that he followed in the Constitution, things that he chose to kind of stretch a little bit, it was all for his kind of for his goal to win the war.

Teacher: Very Machiavellian. Ends justify means.

Sarah Jencks: One of the phrases that I find really powerful from—I don’t know if you all are ever trying to make these connections, I can’t imagine you’re not, but I’m always looking for those threads that sort of go through the 19th century or follow from the Declaration, you know, the different political threads, through to the Civil War and beyond, and Lincoln was a great follower of Daniel Webster, the Whig politician. And one of Webster’s phrases, or his sayings, which is actually on the wall of the National Constitution Center if you ever get to go up there in Philadelphia, it’s ’one country, one Constitution, one destiny.’ And they were struggling with these same issues in, you know, the middle and the early part of the 19th century, too. It didn’t just happen.

Teacher: [Unintelligible]—time we were a country—

Sarah Jencks: Yeah. You’re absolutely right. And so Webster said that. Well, if you go down to the coat in the lobby, Lincoln had those words, ’one country, one destiny,’ embroidered in his overcoat. Literally, an eagle of the Union, with the words ’one country, one destiny,’ embroidered in his overcoat.

Sarah Jencks: So what I’d like to do is to start off by looking at some of the things, specific things that might have been, you know, when we hear presidential speeches and other speeches today, commentators and even regular people can see things, and then you think, oh my gosh, I see they said that, that’s going to be—that’s a buzzword or there’s that kernel of an idea, it’s going to keep going forward, I know it’s going to be an issue. And so the idea here is to partner up and to look for, to try to articulate, we’ve talked a lot about these, but the theory, the sort of proposition about the war that Lincoln makes, and then, secondly, what the policy is that he’s proposing. He makes a statement of a proposition of what the war was all about, and then he proposes a policy.

Teacher: These two people get along fantastically—this person didn’t want to fight the war at all. This person didn’t want a war that would disrupt the institution of cotton and slave [uncertain], because his livelihood would be

Teacher: Right—

Teacher: But he could always turn a blind eye to how the cotton was being produced.

Teacher: Alright, so the theory we’re going with is that there’s blame to go around, right?

Teacher: Right, and the South is not going to be punished. And I guess that’s what she was getting to, in order to understand what happens next, why Lincoln’s assassination was a tragedy is because we know that Reconstruction went in a million different directions.

Teacher: The war is God punishing us for slavery.

Teacher: No, all parties are [unintelligible].

Teacher: Right. Because, I mean, he’s really not talking a lot here about the war to preserve the Union, to preserve states’ rights, he’s really focusing on the slavery issues a lot more.

Sarah Jencks: I call these the POV cards, your point-of-view cards. I want to first ask you, does anybody feel particularly good about what you wrote, not to show off, but you feel like you could—you’d be willing to share with us either your theory or your policy and/or did it bring up any questions that anyone wants to raise with the—

Teacher: We kind of felt that people of the North who really felt that they were sort of fighting to fight would see this as controversial. What do you mean we shared the blame, you know, we don’t have slavery, we’re trying to preserve the Union, and now you’re telling us that we’re partly to blame. I think maybe that’s where some of the controversy lies.

Sarah Jencks: Interesting. Okay. Yes.

Teacher: We also felt that neither the North, kind of going on what Nancy said, that neither the North nor South is going to be happy with his plan of no blame and that, you know, he wanted to move quickly, like the South now is going to be forced to join the Union, which they’re going to be upset about, and the North is going to be angry that they’re not, you know, held as this victorious winner, that he’s really got enemies on both sides now.

Teacher: Northerners don’t want to accept Southerners, Southerners don’t want to accept Northerners, and that 10% loyalty cutoff[?] of which 90% of the population in that Confederate state doesn’t want to be there.

Sarah Jencks: Did any—I don’t know how much you all got to talk about or you read about in the basement museum the election of 1864. What were Lincoln’s chances? What happened? Can anybody sort of revisit that?

Teacher: I think it depended on victory.

Teacher: Yeah.

Sarah Jencks: I’m sorry, say it again?

Teacher: Well, it depended on victory.

Sarah Jencks: Yeah, military victory. So, how was he doing before Sherman started succeeding in the fall? Yeah, it was not looking good. It was all over. And there are amazing images, again, of what happened on the Library of Congress website and on other places, in Atlanta and Savannah. And at the same time just remember, you know, if he hadn’t done that, where would we be? It’s a conundrum. It’s a little bit like the conundrum, when you investigated, of should we have dropped the atomic bomb on Hiroshima?

Teacher: Well, Grant as well. I mean Mike was talking about should Lincoln take the responsibility of the death toll, where if you look at a Sherman or a Grant, their strategy was attrition and just keep throwing bodies at the problem until they run out of bullets.

Sarah Jencks: Yeah, I mean, there’s a lot of controversy over what the best military practice is here. We do a play called The Road from Appomattox and it’s a meeting between Grant and Lee the day after the surrender, which we know took place. We don’t know what happened in it, but we know it took place. Or at least in their memoirs they both say it took place. And one of the things that Lee says is this is the last war that will ever be fought according to conventional rules of war as we know them. And I think that was true in many ways. So.

Sarah Jencks: What else? What else is coming through here, in terms of the controversy of his theory, his controversial theory, or what his proposal was. What is the policy that he’s beginning to articulate here? Maybe we can move on to the policy. Yes.

Teacher: The whole ’malice towards none, charity for all’ is remarkable.

Sarah Jencks: So what’s he saying there? If you were thinking of it from policy terms?

Teacher: Well, it’s directed towards the South. We’re not going to hang the leadership like many wanted to do up north, and after four years of hell, that’s pretty remarkable, that he would keep that focus, on reuniting the country.

Sarah Jencks: Just to repeat myself, is it just directed towards the South, do you think? I mean, what about those Northerners?

Teacher: Stop looking for revenge.

Sarah Jencks: And the border states, it was a really big issue. As you begin to look at Andrew Johnson, one of the issues that we come up against with Andrew Johnson is that he was from a border state. He had been holding out for four years, as a member of the Union, as a legislator and a senator from a state that, essentially, had seceded. But he was maintaining his presence, which was why he was named vice president in the 1864 election. From a state that essentially had seceded from the Union, Tennessee. He was full of vengeance. He couldn’t have been more the opposite of Lincoln.

Sarah Jencks: So having thought about these two, having articulated this theory and then the resulting policy he’s proposing, I want you to take a look at these different Americans—almost all of them are Americans, one is not an American—that you have in front of you on these POV cards. And by the way, I have one more—if anybody needs one, I have one more. And take a moment to think both about how they would have responded to the speech and then, as a follow-up, how they would have responded to the assassination. Abraham Lincoln’s family was from Kentucky, originally, and they—his parents left their Baptist church because it was pro-slavery and they were not. So these are—and even if you can’t make a clear decision, start to think of what the questions are, you know. Okay, in his very last speech before he was assassinated, Lincoln proposed that what he described as ’very intelligent Negroes’ and those who had fought for the Union should be eligible for the vote.

Teacher: Okay.

Sarah Jencks: So. . . .

Teacher: That would give hope, but—

Teacher: Yeah.

Teacher: But this is after the assassination, right?

Sarah Jencks: What happened in South Carolina afterwards actually was that it became the state with the most black legislators during Reconstruction.

Teacher: Right.

Sarah Jencks: Right, so. . . .

Teacher: And that only lasts about 10 years.

Sarah Jencks: Right. Not even. Alright, so. Good questions you guys are bringing up, though. I’m not going to ask you to tell—to go around and say what your person would have thought. But instead, if you want to reflect on some of the questions that you were struggling with or that came up or some of the issues that you had to ask—

Teacher: How about if we know what the person would have thought?

Sarah Jencks: If you know? If you feel certain, then I think you should say what were some of the things that made you know. Okay? Alright. Go ahead. Whoever wants to start, raise your hand or just shout out. Anybody? Okay.

Teacher: Well, we got Andrew Johnson the [unintelligible] legislator from Tennessee, so we already know that he was a little angry and wanted revenge, but was politically-minded enough to go with Lincoln until, you know, his time came. But then because I mouthed off, she gave me another one. And this one was a white merchant in San Francisco, formerly of Delaware. Apparently Delaware was a very small, slaveholding state—

Sarah Jencks: Yeah, but border state.

Teacher: —and this gentleman moved to San Francisco, obviously probably during the Gold Rush, so our idea was we really don’t think this guy cares. He’s in San Francisco, he’s trading, he’s involved with all sorts of ethnic groups and nationalities and he’s there just to make money. So I really don’t think his political opinions are going to be very strong, since he moved from a very small state to a state with more people where there could be more opportunity.

Sarah Jencks: But California came—was strongly in which camp during—

Teacher: In the free state category—

Sarah Jencks: In the free state category.

Teacher: —since the Compromise of 1850.

Sarah Jencks: Okay. Excellent. Good thoughts. What else? Who else? What did you—what were you thinking about as you were going through this process?

Teacher: Right. We were a white Georgetown DC dockworker. We’re wondering why we were unable to fight, but—

Sarah Jencks: Maybe you had like a leg that had a—you broke your leg when you were little.

Teacher:: You have to build your character.

Teacher: Our options are really limited, so we’re really worried now with the freeing of slaves, because all this cheap black labor is going to be coming up from the South and if this—if what you’re saying is basically our case, we have very few options economically to turn to. So if we lose this job. . . .

Sarah Jencks: Not to mention that the Potomac River is about to silt up and there isn’t going to be a dock in Georgetown in 10 years, but you don’t know that.

Teacher: Man.

Sarah Jencks: What else?

Teacher: I just thought it was interesting how you guys think about their reaction to the speech and then to the assassination, and the role that we had was a Massachusetts writer with strong abolitionist ties. And we have very different reactions to the speech and the assassination, that, you know, they’re disillusioned by the speech, and this is not enough. You know, you’ve soft-pedaled down, you’ve taken more of a centrist stance. But the assassination still devastates them because this is, you know, your revered leader who did speak out.

Sarah Jencks: Interesting.

Teacher: We also struggled as an abolitionist with the idea of, you know, having a religious sort of approach to this whole thing, would we have been insulted that, okay, now we’re being lumped in with the sinners who perpetrated this horrible institution, and how dare you try to make us be with them. And then maybe we become more zealous once Lincoln was assassinated—see, now you didn’t want to punish them, now they killed the president on top of it, just sin upon sin on the South, and I’m not part of that. You know, even more stronger regional identity of not wanting to be seen as part of that bigger—

Sarah Jencks: Yeah. Very interesting.

Teacher: And one of our controversies was, just because you’re an abolitionist didn’t mean you believed in equal rights.

Sarah Jencks: So true. That’s so true. Absolutely. There were a lot of Northerners who did not—we sort of tend to say that the Northerners were oh, they were antislavery. Not so much, you know. That was unusual. Absolutely. So the last thing I want to ask you all is if you were to take this into your classrooms, what kinds of things might you want to do to enhance your ability to assess students and/or to develop this into something that would actually work for you. And I know this is really fast, but let’s just quick do some popcorn ideas about this. And the last piece is if you were to use this, is there anything that you feel like you would need to do to scaffold it differently? Yeah.

Teacher: I mean, I teach global, so we were thinking of ideas, possibly doing this with, like, the French Revolution and giving out different characters, or Caesar or any revolution for that matter, and really, you know, coming up with different types of characters and seeing what the kids do.

Sarah Jencks: It does require some research, though. Because as you noticed as I was going—it can be your research or the kids’, you can decide, sort of. You can use it as an assessment tool, or you can give it to them and then say you need to go find out more about these people.

Teacher: We had an Illinois regimental soldier, [unintelligible] Taylor, and we were trying to think what battles that soldier would have fought in. So that would be a springboard to do a little more research about that regiment, get background on—

Sarah Jencks: One thing that has occurred to me just while we’ve been doing this here is that you could potentially do this in part as a Google map activity. You could use Google maps to actually pin where each of the different people were from, and to upload, you know, something so that you’re creating a class project as a result that might allow you to—everybody can make use of it as a tool, ultimately.

What was the effect of the cotton gin on slaves?

Answer

Eli Whitney patented his cotton engine, or “gin,” in 1794. A mechanical device to separate cotton fibers from cotton seed, it dramatically lowered the cost of producing cotton fiber. Formerly, workers (usually slaves) had separated the seeds from the lint by hand, painstaking work that required hours of work to produce a pound of lint. By mechanizing the process, the gin could produce more than 50 pounds of lint per day. Cotton fabric, formerly quite expensive due to the high cost of production, became dramatically cheaper, and cotton clothing became commonplace. In the early decades of the 19th century, Southern farmers shifted more and more of their acreage into highly profitable cotton production, and large-scale plantation agriculture became common in the Deep South states of Georgia, Mississippi, Alabama, and Louisiana. The gin’s effect on the economy and on the lives of the slaves who made up a significant part of that economy was complex. The cotton gin freed slaves from the arthritic labor of separating seeds from the lint by hand. At the same time, the dramatically lowered cost of producing cotton fiber, the corresponding increase in the amount of cotton fabric demanded by textile mills, and the increasing prevalence of large-scale plantation agriculture resulted in a dramatic increase in the demand for more slaves to work those plantations. Overall, the slave population in the South grew from 700,000 before Whitney’s patent to more than three million in 1850—striking evidence of the changing Southern economy and its growing dependence on the slave system to keep the economy running. Cotton cultivation proved especially well-suited to slave labor. A relatively delicate plant, growing and harvesting cotton was a labor-intensive process. On large Southern plantations, much of that labor was provided by slaves working in gangs. Gang labor fit the slave system particularly well: dozens of slaves collected into a work crew could be supervised by a single white overseer, which made for more efficient work. Unlike solitary jobs like shepherding, which made constant supervision of individual slave workers extremely difficult from a practical standpoint, gang labor in the cotton fields allowed one overseer to supervise (and, when necessary, to discipline and punish) large numbers of slaves simultaneously.

Any invention that encouraged the growth and expansion of the institution increased the misery of slaves in the aggregate acutely

On large cotton plantations both the work and the punishments were unremitting and unforgiving. During the height of harvesting season, slaves worked from sunup to sundown; when the moon was full, they worked into the night as well. Slaveowners varied in their reputations for physical violence, but none eschewed punishment completely in the quest to extract more labor from their charges. Beatings and whippings were frequently used to coerce recalcitrant slaves; slaves who resisted labor or attempted to escape were punished with mutilation, sale away from their families, and occasionally death. There is no simple calculus to determine whether and how the cotton gin affected the lives of individual slaves. It is possible that the adoption of the gin made the working hours of a few individual slaves somewhat less difficult. However, given the barbarity of slavery generally—rampant physical and sexual abuse, the separation of families, lives of forced labor in acute deprivation, and the overarching dehumanization that the system enforced—it seems clear that any invention that encouraged the growth and expansion of the institution increased the misery of slaves in the aggregate acutely. Given the cotton gin’s effects on the spread of large-scale cotton agriculture and the resultant growth in the institution of slavery in the first half of the 19th century, it is difficult to portray its introduction as anything other than a disaster from the perspective of enslaved African-Americans.

As I understand it, Robert Gould Shaw's parents decided to leave him buried in the mass grave near where he was mortally wounded at Fort Wagner. Is he still buried in that location beneath the sand? Is it now under water? Is there some sort of marker designating the burial spot?

Answer

Colonel Robert Gould Shaw (1837-1863) was the young white Civil War Union army officer who commanded the otherwise all-black 54th Massachusetts Volunteer Infantry. He was killed while leading a fierce but unsuccessful charge by his troops on the sand and earth parapets of Fort Wagner on Morris Island near Charleston, South Carolina, on July 18, 1863. The 54th Massachusetts lost many men that day, with a casualty rate of over 50%. The other Federal units in the attack suffered heavy losses as well. Union casualties for the day numbered more than 1,500. Union Brigadier General Quincy Granville sent an inquiry to the Confederate commander of Fort Wagner, asking about the disposition of Shaw’s body. The reply was that Col. Shaw had been “buried with his niggers,” in a common grave, a trench along the island’s shore, close to the fort. Indeed, this was where all the Union dead were buried on the tiny island. Whether or not the Confederate commander thought of this as inflicting a particular insult on Shaw, this is how it was taken in the North, especially because Shaw’s fellow officer, Col. Haldimand Putnam, commanding the 7th New Hampshire Infantry, who also died in the attack, “received all the honors of sepulture which the circumstances of his death permitted, from the fraternal hands of his West Point classmate, General Robert H. Anderson, of the Confederate Army,” although his body was not recovered. Nevertheless, even in the few days immediately after the bloodbath, Shaw had become, in the North, an uncommon martyr for the principle of black emancipation, and sentiment sprang forth to exert every effort to exhume his body and rebury him back in his hometown of Boston as a hero. Shaw’s parents, however, prominent in Boston as strong abolitionists, resisted this sentiment. His father sent instructions to the officers of his son’s regiment, writing, “We would not have his body removed from where it lies surrounded by his brave & devoted soldiers, if we could accomplish it by a word. Please to bear this in mind & also, let it be known, so that, even in case there should be an opportunity, his remains may not be disturbed.” By September, the decomposition of the bodies in the trench had begun to contaminate Fort Wagner’s Confederate defenders’ fresh water supply, and they abandoned the fort as a consequence. Union soldiers immediately moved in, but, guided by Shaw’s parents’ wishes, did not exhume Col. Shaw’s body. Morris Island is smaller than 1,000 acres and is subject to extensive erosion by storm and sea. Much of the previous site of Fort Wagner has been eroded away, including the place where the Union soldiers had been buried. However, by the time this had happened, the soldiers’ remains were no longer there because soon after the end of the Civil War, the Army disinterred and reburied all the remains—including, presumably, those of Col. Shaw—at the Beaufort National Cemetery in Beaufort, South Carolina, where their gravestones were marked as “unknown.” The Boston area has at least three memorials to Robert G. Shaw. In 1897, the Harvard Memorial Society erected a tablet on Massachusetts Hall, which had long served as a dormitory, that listed some of its past student residents who had gone on to fame. This tablet included Shaw’s name (he had been a Harvard student, but had withdrawn before graduating), along with such other notables as Artemas Ward, Elbridge Gerry, Francis Dana, Joseph Story, Jared Sparks, and Francis Parkman. The Shaw family also placed a bronze tablet in memory of Robert Gould Shaw on an earlier-installed cenotaph in its family plot at Mount Auburn Cemetery in Boston. The most well known memorial, however, is the Robert Gould Shaw and Massachusetts 54th Regiment Memorial. It is a bas-relief of Shaw and his men, designed by Augustus Saint-Gaudens, and placed on Boston Common, across Beacon Street from the Massachusetts State House, in 1897. The memorial was the focus of attention during the late 1980s and early 1990s, concurrent with the making of the film Glory, that depicted the actions of the 54th Massachusetts at Fort Wagner. It occasioned a public reassessment of the fact that, beginning from the immediate aftermath of the attack, a significant portion of the sentiment of white Northern abolitionists had elevated Shaw’s place as a determined sacrificial martyr to the cause of black emancipation far above the level of the other men of the 54th Massachusetts, almost as if the black men of the 54th could do nothing by themselves without a white savior in the person of Shaw. Abolitionist Eliza Sedgwick’s 1865 poem about Shaw contained the lines: “Buried with the men God gave him—Those who he was sent to save; Buried with the martyred heroes, He has found an honored grave.” Shaw’s mother and father did not have a patronizing view of the relationship between their son and his men and indeed shared a sentiment of African American empowerment that was embodied in a line from Lord Byron that abolitionists often quoted—“Who would be free themselves must strike the blow.” They objected to the original design for the memorial because it showed their son on horseback, elevated above the figures of the enlisted men around him on foot. Nevertheless, a public commission funded Saint-Gauden’s bas-relief, which portrayed this design, and it was dedicated as a memorial to Shaw. The public reassessment of the 1990s eventually refocused the memorial on the 54th Massachusetts as a whole, rather than on Shaw in particular.

While many Quakers owned slaves prior to the American Revolution, the Quakers passed a rule in 1758 forbidding their members to buy or sell slaves. This lesson examines how the Quakers' religious views influenced their opposition to slavery during the Revolutionary period. We like that students are asked to analyze a series of primary sources to identify the reasoning behind the Quaker's anti-slavery stance.

Article Body

The lesson plan suggests that teachers begin by delivering a lecture based on an online talk by historian Jean Soderlund. (Adobe Flash Player and Acrobat Reader are required to access the lecture). However, the historian’s lecture is brief, informative, and fairly engaging, so teachers may want to consider playing the lecture for students.

Next, students are asked to read a set of documents written by Quakers in the 18th century, and identify the various reasons Quakers were opposed to slavery. The documents are rich and informative. However, the language is challenging; and teachers may need to modify and shorten the documents, and create guiding questions to help students analyze them.

For an assessment, middle school students create protest pamphlets expressing the reasons behind Quaker opposition to slavery. High school students analyze the Declaration of Independence from the Quaker perspective. High school teachers may want to consider having students also analyze the original draft of the Declaration of Independence which had much stronger language opposing slavery. The original draft of the Declaration of Independence reflects more of Jefferson’s personal views, while the final version reflects more of the consensus view of congress.

Slavery, legally sanctioned in the south, and for a long time in the north as well, was supported at every turn by legal structures. So, something that I like to use a lot in teaching, just to get students thinking about this, are—these are receipts, these are receipts. And, the one I'm holding right now is dated Norfolk, September 17, 1853. It's a printed receipt that's been filled out. It's something that, it's very similar in a way, to something that you might buy at an office supply store. If you went and needed a book of receipts because, you know, you had a business.

It's got a blank space that you can fill in the place and date. And then it says 18-five and blank.

So just like today in writing a check you might have—or a set of receipts—just to make things easier they might write two-zero-zero and then you can put in 2009, or 2008, or something like that. Just to make it just a little easier in filling out a receipt. It's got this, it's for—it's obviously a book of receipts that you can fill out all through the 1850s. Then it says, "Received of 'blank,' 'blank' dollars, being in full for the purchase of 'blank' Negro slave named 'blank.' The right and title of said slave 'blank' warrant and defend against the claims of all persons whatsoever, and likewise warrant 'blank' sound and healthy, as witness my hand and seal," and then the title of this. And it's a very elegant 19th-century receipt. It's in a nice filigreed kind of handwriting, it's got lovely illustrations on the side that depict kind of the engines of commerce for the time. There's a steamboat and there's a clipper ship and there's a railroad.

And it says, "Murphy and Company, Printers, Baltimore." Thinking about it, how many people are involved in this receipt? It's been printed by a printer in Baltimore, but it's been printed for probably a lot of people. But, this one in particular, it's noted it's sold by a bookseller in Richmond. This particular receipt is dated in Norfolk.

Now, if you were teaching students, using this for the classroom, one of the first things you might want to do is list all of the locations that are on this receipt and any of the other receipts, you know, so that students get a sense of the geography of the place. Like, where is Baltimore in relationship to Richmond? Where is Norfolk and why might this receipt be dated in Norfolk?

The thing, as an historian, that strikes me about these documents is, first, how mundane they are, how banal they are, how similar they are to the kinds of—the book of receipts that you could pick up today. But then, to realize that the people that are kind of in this kind of elegant handwriting, that are signing their names to this receipt, are engaged in the sale of humans.

This particular receipt from Baltimore, dated in 1851, "warrants and defends against the claims of all persons whatsoever and likewise warrants sound and healthy and slaves for life." So, it's almost identical, but it adds the little phrase "and slaves for life," that none of the others do. So, you ask yourself, "Well, what might account for that little bit of fine print, that little legal boilerplate being added to this receipt?"

People keep records of property in a way that they don't keep of people, and they lay—these records stay around with us for a long time.

You often will hear that, well, the Emancipation Proclamation didn't free any slaves really, because it only was under effect for those areas that weren't under the control of the Union Army. But what it did do, was take this huge amount of capital that was vested in slaves and wiped it out. It just erased billions of dollars of capital. It's one of the reasons that New York City was such a hotbed of pro-slavery sentiment, because the banks and the trading houses in New York City were very invested economically.

We know that, in this particular one, "Received of Charles H. Shield, Esquire, 1,000 dollars, being paid in full for the purchase of a Negro slave named Mary and her child, Louisianna. The right and title of said slave, I warrant and defend against the claims of all persons whatsoever," and it's signed by William W. Hall. So, Charles Shield and William Hall are engaged in the transaction of Mary and her child. But this is a legal document. Think about what is the backing? What is the legal claim that this receipt gives to the bearer? So that there's a certain#&8212;in other words, it's kind of to demonstrate that I have the legal right that I've been given by the seller, to the ownership of Mary and her child. The other thing, of course, you keep receipts for, is in case you have to return something.

It's very similar when you think about it, to the kinds of promises that you make when you're buying anything. Here—there's a warrant. In other words, someone is making a kind of authoritative claim and "defend against all claims of all persons whatsoever." So, by that, in other words that, "I have legal title to these people, and I warrant, I signed this in warrant that in fact, I'm transferring that title to the bearer, and I likewise warrant them sound and healthy, as witnessed by hand and seal." So, they're making a claim about these people, and it's not surprising that they make a claim about this. As I said, the law is imbued in every aspect of slavery, including all of these kinds of transfers, these kind of transfers, the sale of slaves. And there's a whole kind of, a set of legal laws about, "Well, what would happen if you sold a slave to someone, and the slave died? What if the person knew that they were ill? So, what does it mean to say that someone is healthy?" and what, what are the kinds of—these things come up. The courts serve the function of making sure that the business of slavery proceeds in an orderly fashion.

This is all about the buying and selling of people. But, there's this huge set of laws that are protecting every transaction. So, a lot of this printed language is what a lot of people, they'll refer to it as "boilerplate." This is the fine print, the fine print of the sale of slaves, that has a special meaning for every jurisdiction that this receipt is made out in.

The state, whether it's Virginia here or elsewhere, does have an interest in knowing about this, in part, just to keep track, but also because these transactions are often—they'll say "paid in full," but they're really also backed by loans. People are buying slaves on credit. It's very speculative. So, there are banks, insurance companies, who also have a stake in the ownership of Mary and her child, Louisiana, that may go far beyond Norfolk and the environs.

Now, one thing that this document won't tell you is, in and of itself, and I can't say that I know the answers to this myself, but who William Hall and Charles Shield are, but you can kind of make some educated guesses. This is happening, the sale is recorded in Norfolk, Virginia. Norfolk is, it's on the coast. It's 1853. Virginia is an old part of the kind of slave south of the Chesapeake [region]. There are hundreds of thousands of enslaved people in Virginia. But, the real money in 1853 to be made in slavery, is not in Virginia. It's in the new southwest. It's in places like Louisiana and Alabama, Mississippi.

A lot of legal cases developed over this because people wanted to make sure they were getting maximized profits for the sale of the estate, including slaves. It was found that "items sell best when sold separately." In other words, given the opportunity to sell a family, self-contained as a lot, to an individual, or to sell them as individuals, more money would be made selling them as individuals.

And, because the courts have a fiduciary responsibility in making sure that the heirs get the best bargain that they can from the estate, they're mandated to sell separately. So, it reminds one that there are hundreds of thousands of families that are being broken up through these types of trade. It's also a good thing to stop and think about how often we talk about the transatlantic slave trade, but to consider the domestic slave trade as well, as being a great tragedy and something that continued to wreak havoc for years and years. Some of the saddest documents that one can find are in African American newspapers and magazines, sometimes 10, 20 years after the Civil War. They're often called "Information Wanted" notices, looking for a mother or a sister or a child, still trying to find their family members.
